• 3 <br />However, such approval is not necessary for individual units <br />of government or private entities acting alone. <br />OWASA suggests that the statutes be amended to require the <br />same scrutiny of all water diversions, regardless of whether <br />an entity is acting alone or in partnership with others. <br />2. G.S. 153A -287 categorically prohibits water diversions from <br />all river basins except the Cape Fear, Neuse, Tar - Pamlico, <br />lower Roanoke, and the small coastal basins. <br />If the waters of North Carolina are to be managed under a <br />uniform and logical statewide policy - and since the EMC <br />already possesses the statutory and regulatory tools to <br />evaluate potential transfers (G.S. 162A -7) - then it seems <br />logical to repeal G.S. 153A -287, and manage all waters of <br />the state according to the same principles. <br />• 3. The statutes should address the withdrawals, diversions, and <br />consumptive uses of agricultural and industrial users where <br />water is not returned to the stream because of irrigation, <br />process, or evaporative losses. <br />OWASA appreciates this opportunity to share our concerns and <br />recommendations. We need help from the elected representatives <br />of our customers and your citizens in opposing this undesirable <br />legislation and supporting a sensible and comprehensive state <br />water use policy that will, in fact, enhance good management of <br />the state's water resources. <br />0 <br />
