T <br />Fri <br />shall distribute to the Trust all of the monies it thereafter receives <br />or which it has received but not yet reinvested pursuant to this and <br />all Shared Equity Agreements hereunder, then contracted for, and /or <br />outstanding. <br />D. Town's Power Authority, and Certifications. In <br />entering into, undertaking, and carrying out this Agreement, the Town <br />is exercising to the fullest extent, without limitation or waiver of <br />any and all other powers and authority which the Town may have and <br />enjoy by statute, charter, local act, or common law, its powers and <br />authority granted to it by State statute, local act, or its charter, <br />including without limitation the power and authority to act as a <br />housing authority pursuant to N.C.G.S. Section 157- 4.1(a). The Town, <br />through its Town Council, has approved, has authorized, and adopts <br />i <br />this Agreement; has authorized the Town Manager and Town Clerk to <br />execute and deliver this Agreement; and has authorized and empowered <br />the Town Manager and the Town staff to take- such action on behalf of <br />the Town, as the Town Is..authorized representative (s) as may be <br />necessary or desirable to perform and carry out the provisions of this <br />Agreement, as shown in Town Resolution No. The Town shall <br />expedite to the fullest, extent practical its consideration of all <br />necessary applications, reviews, processing, schedules, and regulatory <br />matters, consents, and approvals.
