{ <br />Market Houses, roads, and water and sewer. lines. Such amendments <br />and /or modifications to the said construction shall not be deemed a <br />breach of this Agreement. All Material Changes in the Low - income <br />Houses require the Town Manager's written consent, which consent shall <br />not be unreasonably withheld or delayed; provided, however, that <br />nothing in this Agreement shall be construed to permit initial <br />construction of a Low - income House to exceed 1200 square feet (using <br />exterior wall calculations) or to obligate the Town to contribute <br />construction funds despite any increase in the maximum amount <br />originally budgeted for construction or to limit the Town's authority <br />and obligation to supervise construction under its police power. <br />D. Inspections. During construction of the Low - income <br />Houses, the Town has the right to inspect their construction at <br />i <br />reasonable times, with or without notice, provided that such <br />inspection shall not interfere unreasonably with construction work in <br />progress. Such inspections shall be conducted by the Town's Manager <br />or his designee, or then Town's Building Inspector, who shall be <br />accompanied by a representative of the Corporation. The purpose of <br />any such inspections shall be to observe whether or not the <br />construction is in compliance with the terms and conditions of this <br />Agreement; however, this Agreement shall not be construed so as in any <br />way to limit the authority of the Town to perform its duties and <br />functions pursuant to applicable provisions of local ordinances and <br />the Charter of the Town, and State and Federal laws and regulations. <br />III. Budget. The Low - income Houses and Market Houses are <br />intended to be built in accordance with the Budget such that, if said <br />houses are so built and the proceeds of sales are so allocated, the <br />- 9 - <br />
