It <br />seems to me that in the case of Habitat's request, however, the <br />only relevant factor listed above would be the purpose for which <br />the service was received. Arguably, the services being received <br />by Habitat are being received by it in order that it can provide <br />low or moderate income housing, a stated important public policy <br />concern of Orange County. The fee exemption provision in the fee <br />ordinance must, however, be broad enough to include all <br />applicants within that same classification. This can be tricky. <br />The proposed policy included with your September 5, 1990 <br />memorandum does, I think, a credible job in creating a <br />classification of applicants to be exempted from fee requirements <br />based on the notion that the purpose of the fee recipient is to <br />provide affordable housing to low and moderate income residents <br />of Orange County.
