NORTH CAROLINA'S CHILD DAY CARE LICENSING LAW <br />34 <br />N.C. State ~Law (Article 7, Chapter 110 of the Generol Statutes) governs day <br />care arrangements In which three or more children under 13 years of age <br />receive care away from their own home by persons other than their parents, <br />grandparents, aunts, uncles, brothers, sisters, guardians or full -time <br />custodians, or in their. own home when unrelated children ore also In care, <br />The Child Day Care Commission adopts the requirements for these day care <br />arrangements, and the Child Day Care Section of the Division of Facility <br />Services Inspects them for compliance and issues the license (permit to <br />operate). <br />The maximum number of children that may be in care at one time determines the <br />requirements that a day care program must meet. The Commission has adopted <br />regulations for five sizes of arrangements: small and large child day care <br />homes; and small, medium and large day care centers. The term "home" Is <br />used for the two smaller sizes of programs because they are usually in a family <br />residence, but they occasionally may be located elsewhere. The requirements <br />summarized in this pamphlet are for large homes. A person cannot be <br />held liable for making a report if he is acting In good faith, even If it Is <br />found that the child has not been abused or neglected. When reporting, give <br />the department of social services at/ the Information you knew about the child <br />and the circumstances of abuse or neglect. <br />What Are Abuse and Neglect? <br />Abuse occurs when the parent or caretaker, of a child harms the child <br />physically or emotionally. Encouraging or Involving the child In Immoral, <br />Indecent _or delinquent .activities, including pornography, is another form of <br />child abuse, os Is committing or allowing any sexual act with a child. <br />A neglected child i.s one who does not receive proper rare. , supervision or <br />discipline; or who Is ahandoned. Neglect may occur when a child Is not giver, <br />necessary medical or remedial care, or when he lives In ore environment which <br />may he harmful to his welfare. A child who is placed for care or adoption in <br />violation of the low is also considered neglected. <br />Some signs of physical abuse are bruises, burns, cuts, scars, and vaginal <br />discharge or disease. An emotionally abused child might be unusually quiet or <br />timid, overly active or aggressive, or especially afraid or affectionate with <br />strangers.
