0 <br />1° <br />PROPOSED ORDINANCE AMENDMENT <br />ORDINANCE: Zoning Ordinance <br />REFERENCE: Section 4.2.27 PW -II District <br />Section 4.2.28 WQCA District <br />ORIGIN OF AMENDMENT: X Staff Planning Board <br />BOCC Public Other: <br />STAFF PRIORITY RECOMMENDATION: High X Middle Low <br />Comment: <br />PUBLIC HEARING DATE: December 11, 1990 <br />PURPOSE OF AMENDMENT: <br />To correct a technical discrepancy between the Zoning Ordinance and <br />Zoning Atlas, and provide consistency in wording. <br />IMPACTS /ISSUES: <br />Section 4.2.27 of the Zoning Ordinance describes the intent of the PW- <br />II Protected Watershed Zoning Overlay, and identifies the areas to <br />which the overlay may be applied. The application criteria <br />specifically refers to the zoned portions of the University Lake, Cane <br />Creek and Upper Eno Watersheds. At the time that the PW -II district <br />was first adopted, these were the only water supply watersheds <br />designated on the Comprehensive Plan. <br />In late 1988, the Land Use Element of the Comprehensive Plan was <br />amended to designate Back Creek, Flat Creek, and Little River <br />Watersheds as Water supply Watersheds. Although the water impoundment <br />to which the streams flow is not located in Orange County, is it like] <br />that the water contained within those impoundments may be used by <br />residents of Orange County in the future. <br />The Zoning Atlas we's also amended in late 1988 to apply the PW--II <br />Zoning Overlay to the portions of those watersheds within Cheeks, <br />Hillsborough and Eno Townships. Article 4.2.27 of the Zoning Ordinance <br />should have been amended at that time to reflect the expansion of are <br />designated as.water supply watershed. <br />Article 4.2.28'describes the intent and application criteria for the <br />WQCA Water Quality Critical Area overlay. The proposed amendment to <br />this section is for clarification only. <br />
