MOTION: <br />7 <br />steepness of slopes in relation to the proposed <br />roads and whether private roads may be <br />appropriate. Crudup responded that paved roads <br />were recommended since they would provide safer <br />access and less long term maintenance on the <br />steep slopes. <br />Best moved approval as recommended by the <br />Planning Staff. Seconded by Lewis. <br />VOTE: Unanimous. <br />b. Other Plats <br />M04010,(1) Lori Berry - Partial Width Right -of -Way . <br />Presentation by Mary Scearbo. <br />On October 4, 1990, Planning Staff approved <br />a Minor Subdivision Concept Plan for the Berry <br />property. The subdivision is located on-the west <br />side of NC 57, approximately 1470 feet (.28 m.4-le <br />south of Phelps Road (SR 1551). <br />The total lot size is 6.49 acres. A Class C <br />private road approximately 850 feet in length is <br />proposed along the southern boundary of the <br />property. An existing well is located about 25 <br />feet from the property line within the first lot. <br />An existing house is located on the lot. <br />Reduction of the right -of -way from the required <br />50 feet to 25 feet is needed to exclude the well <br />from the private road right -of --way. The <br />remainder of the right -of -way will be 50 feet in <br />width. Staff can identify no reasonable <br />alternative to the proposed location of the road. <br />Shifting the right -of -way to the northernmost <br />property line would conflict with the <br />existing septic system. <br />All adjoining properties have more than <br />adequate road frontage. It is not likely that <br />the proposed road would ever be extended to <br />serve additional lots. <br />There is no justification to support a flag <br />lot. <br />The Planning Staff recommends approval of a <br />partial width right -of -way of 25 feet for the <br />specified portion of the private road. <br />
