C <br />GENERAL ASSEMBLY OF NORTH CAROLINA SESSION LM - 13 <br />1 <br />Nowithstanding any r vi i n of this section. the hm n <br />2 <br />a vested ri ht shall not, gredwd-e. h air the authqdix <br />3 <br />a county to adopt and gnfgTce zoning ordinance rovis ons <br />4 <br />g vo erning nonconforming situations or uses. <br />5 <br />L i cgllangous <br />provisions. <br />6 <br />A vested right obtained under this section is ngt a Rersonal _right. <br />7 <br />but shall attach to and _ run with the applicable prQRerty __After <br />8 <br />approval of a _ site specific development __Rlan -or _ a hn ased <br />9 <br />development plan, all successors to the original_ landowner shall. be <br />10 <br />gntitled to exercise such right <br />11 <br />Nothing in this section shat preclude judicial determinatign. based <br />12 <br />on common law principles_ or other, statutory provisions. that _a <br />13 <br />y s ed right exists in a particular case orthata.!ompgnsable taking <br />14 <br />has occurred. Except as expcessly provided in this section. nothing <br />15 <br />in this section shall be construed to alter the existing common law. <br />16 <br />In the event a county fails_so_ adopt_ an_ ordinance setting, forth what <br />17 <br />constitutes -a _-site specific development_)lan triggering a vc1ted <br />18 <br />right, a landowner may establish _a_ vested right with_ respect to <br />19 <br />proerty uggn, the approval of a zoning permit, or otherwise may <br />20 <br />seek appropriate relief from the 5u2erigr Coart Division of the <br />21 <br />General Court of Justice." <br />22 <br />= Sec. <br />7.
