III <br />ON <br />ji o <br />D. The services developed under this agreement shall serve families of all <br />income levels. <br />E. The place of this agreement, controlling its status and form, shall be <br />Wake County, North Carolina, and all matters relating to the validity, <br />construction, interpretation, and enforcement of this agreement shall be <br />determined in the courts of Wake County. Any suit in federal district <br />court relating to this agreement shall be brought in the United States <br />District Court, Eastern District of North Carolina, Raleigh Division. <br />IV. Responsibilities Under the Memorandum of Understanding: <br />A._ The Department of Human Resources shall: <br />1. subject to the availability of Federal funds, disburse a single <br />check in the amount of $10,000 to the Grantee when this Memorandum <br />of Understanding has been signed by all parties. <br />2. monitor the Grantee's compliance with the terms of this agreement. <br />B. The Grantee shall: <br />1, plan, develop, establish, expand or improve school -age child care <br />services for dependent persons as defined in the law and according <br />to Attachment I to this agreement. <br />2. spend grant funds in accordance with the approved budget. <br />3. return any grant monies not spent during the grant period to the <br />Child Day Care Section. <br />4. provide the Child Day Care Section fiscal and grant activity <br />reports for the period October 1, 1990 through March 30, 1991 and <br />for the period April 1 through September 30, 1991. These reports <br />are due April 25, 1989 and October 25, 1991, respectively. <br />5. maintain program and fiscal records for this grant for three years <br />after the termination of the grant or until any audits in progress <br />C <br />
