48 <br />MEMORANDUM <br />TO: TRANSPORTATION ADVISORY SUBCOMMITTEE <br />FROM: MARVIN COLLINS, PLANNING DIRECTOR <br />DATE: AUGUST 10, 1990 <br />SUBJECT: PRIVATE ROAD STANDARDS <br />COPIES: JOHN LINK, COUNTY MANAGER <br />GEOFFREY GLEDHILL, COUNTY ATTORNEY <br />BETTY EIDENER, PLANNING BOARD CHAIR <br />BARRY JACOBS, PLANNING BOARD VICE -CHAIR <br />GENE BELL, PLANNER III <br />At the July 10, 1990 meeting of the Planning Board, I <br />expressed concerns about proposed amendments to the Private <br />Road Standards and Subdivision Regulations. On the same date, <br />I met with the County Attorney to discuss those concerns. On <br />August 1, 1990, I provided a list of specific concerns <br />regarding the provisions to the Planning Board. <br />Listed below is a summary of the provisions /concerns. <br />If the proposed changes are not evident, alternate <br />wording is provided in italics after the discussion of each <br />concern. I believe the new wording more accurately conveys <br />the intent of the TAS as expressed at the August 1 Planning <br />Board meeting. <br />IV- B -3 -b. All subdivisions containing private streets <br />shall have at least one street which <br />intersects with or joins an extension of a <br />public, state, or municipal maintained street. <br />The provision was added to restrict subdivisions containing <br />new private roads from obtaining access to an existing <br />private road. Problems have resulted because of the increased <br />number of lots to be served by an existing private road. The <br />road class may be upgraded from private to public, from Class <br />B Private to Class A Private,-or from Class C Private to <br />Class C Private, depending upon the total number of new and <br />existing lots to be served. <br />In upgrading a road from one private class to another, there <br />may be no problem other than the ability to secure /provide a <br />road maintenance agreement for the existing private road. In <br />some cases, however, a subdivider may have to incur <br />considerable expense to upgrade the road or homeowners must <br />
