E <br />standards set by Orange County, as descr ibed <br />in Appendix A of the Subdivision Regulations. <br />Satisfactory proof that the standards are met <br />will be required by the County Manager or his <br />appointed agents. If a subdivision is to <br />contain private roads, the subdivider shall <br />have an instrument recorded contem oraneousl <br />with the final plat su]?stantially in the for <br />of the County's Standard Road Maintenance <br />A ree ent entitled "DECLARATION OF <br />RESTRICTIONS AND PROVISIONS FOR PRIVATE ROAD <br />MAINTENANCE", guarantee (a) a right of access <br />to any private road in the subdivision by all <br />lots served by the road and by law enforcement <br />and emerggncy emergency vehicles b right of access <br />for the-proposed 1priyate road to a State a-r- <br />munickpally maintained road by way of direct <br />access or other rivate roads (c) perpetual <br />maintenance of any private road serving the <br />subdivision at the standards set for approval, <br />and d provide record notice of the <br />probability that future develpippent de endent <br />on the riv to roads for access wi 1 re au' e <br />uoarad,ing of the road to North Carolina <br />De artment of Trans ortation standards. See <br />Section V -D -6 -b 2 for additional <br />reguirements. <br />(The proposed amendments require the <br />subdivider to record a copy of the Road <br />Maintenance Agreement with the final plat, <br />expand right of access to include public <br />safety vehicles, clarify that each lot must <br />have access from a public or private road, and <br />puts property owners on notice that future <br />development dependent on private roads for <br />access will require upgrading to a higher <br />private road standard or dedication and <br />upgrading to State standards.) <br />underline = proposed text retained <br />bold = TAS /PS revision <br />
