The properties associated with the Project are located within different land use <br /> categories as depicted on the Future Land Use Map (FLUM) contained within <br /> the adopted 2030 Orange County Comprehensive Plan. <br /> Those properties comprising District(s) 1 and 2 are located within the <br /> Economic Development Transition Activity Node. The properties contained <br /> within what is designated as District 3 are located within the Rural Residential <br /> land use category. <br /> Per Appendix F Land Use and Zoning Matrix of the Comprehensive Plan the <br /> MPD-CZ zoning category is permitted for development within the following <br /> land use categories: <br /> • 10 and/or 20 Year Transition; <br /> • Commercial Transition Activity Node; <br /> • Commercial/Industrial Transition Activity Node; and <br /> • Economic Development Transition Activity Node. <br /> District 3, which is located within the Rural Residential land use category, is <br /> not a designated land use category allowing for the rezoning of property to the <br /> MPD-CZ designation. The Project scope and narrative will have to be <br /> modified to include a request to change the FLUM land use designation of the <br /> properties contained within the aforementioned district in order to move <br /> forward. <br /> STAFF COMMENT: Current Planning staff was informed by the <br /> Planning Director on or about August 9, 2017 the Department would <br /> assume the responsibility to modifying the designation of the properties <br /> comprising District 3 to address the issue. <br /> At the writing of.this letter staff is recommending the properties <br /> contained within District 3 be changed from the Rural Residential land <br /> use category to Economic Development Transition Activity Node. <br /> This would ultimately allow for the processing of an application , <br /> proposing rezoning of parcels to MPD-CZ from a Comprehensive Plan <br /> standpoint. <br /> IL IN GENERAL—APPLICATION PACKAGE AND NARRATIVE: <br /> a. Update the application submittal to ensure the County has all necessary <br /> documentation denoting the properties subject to the Project are either under <br /> contract or you have legal authority to include same. <br /> b. Staff is recommending the inclusion of a table of contents to aid in review. <br /> Further individual tabs denoting various sections should be included in future <br /> copies provided to the County as part of the Planning Board and Board of <br /> County Commissioners (BOCC) review of the project. <br /> 1 <br />
