(Refer to <br />the attached Staff memorandum for a comparison of the <br />applicant's request with the criteria set forth in <br />Section II- D--2 -e of the Subdivision Regulations.) <br />The attached letter from the applicant's agent states <br />that improvements will be completed by August 1, 1991. <br />The applicant's agent has indicated an intent to - <br />complete landscaping and road improvements by December <br />1, 1990. <br />In their August 20th meeting the Planning Board <br />recommended that the deadline for receiving approval <br />of the Final Plat for Four Birches be extended to <br />December 1, 1990. It was further recommended that if <br />improvements are not completed by that date, the <br />letter of credit or escrow agreement securing <br />completion would be written to expire on August 1, <br />1991. <br />ION: The applicant's justification for a revised phasing <br />plan, when compared with the criteria set forth in <br />Section II- D -e -2, does not present a strong case for <br />approval. However, the revised phasing will not <br />extend the time limit for completion of improvements. <br />This factor is the basis for the administration <br />recommendation for approval. <br />It is further recommended that Section II -D -e -2 of the <br />Subdivision Regulations be amended to add that a <br />phasing plan may be approved if the time available <br />to complete the construction of improvements is not <br />extended. <br />
