• C <br />3 <br />suggestions: <br />Include in Section 2.3.5 the word "surface" in <br />referring to land application wastewater systems <br />which require environmental review. <br />Incorporated into attached draft. <br />- Revise Section 3.1.4 to require that the Board of <br />Commissioners determine if an EIS will be required <br />if the applicant disagrees with the Planning <br />Department decision. <br />The text was modified by staff to allow for appeal <br />of the requirement for an EIS to the Board of <br />Commissioners after receiving a recommendation from <br />the Planning Board. The Administration recommends <br />against this modification. <br />2. A letter from William Spang (attached) was submitted <br />into the record and included the following concerns: <br />- "Failure to provide adequate protection of natural <br />and cultural resources" is a vague criterion for <br />requiring an EIS. <br />Methods of providing adequate protection are <br />described in amendments to the subdivision <br />regulations. The appropriate protection <br />strategy for a particular site will depend on <br />its significance, and the nature of the project. <br />The County Environmental Planner will review the <br />proposed means of protection. Any decision to <br />require an EIS will be brought before the Board <br />of Commissioners if the applicant feels that is <br />an unfair requirement. <br />- Would sludge disposal in a Water Quality Critical <br />Area require preparation of an EIS? If so, why not <br />change the criterion from "land (surface) <br />application" of wastewater to "sludge disposal" ? <br />Sludge disposal is one type of land application <br />of wastewater, and would require preparation of <br />en EIS if proposed in a Water Quality Critical <br />Area. There are other land application systems, <br />however, such as spray irrigation, which would <br />also require preparation of an EIS. <br />3. Commissioner Hartwell cited the example of <br />constructing a two -acre pond on a portion of a much <br />larger parcel. A concern was the expense of <br />providing topographic information for the entire <br />
