M M 9 T 7 .a <br />The property is located at the northeast <br />intersection of Hopkins Road (SR 1537) and Bill <br />Poole Road (SR 1536) in Little River Township. <br />The property is not zoned and the Land Use Plan <br />designation is Agricultural Residential. <br />On July 25, 1990, the applicant submitted an <br />application for Final Plat approval. The <br />application was considered incomplete since the <br />required improvements (roads, landscaping) had <br />not been installed and security was not provided <br />for their completion. On August 1, 1990 the <br />Preliminary Plan approval expired, since twelve <br />(12) months had elapsed without Final Plat <br />approval. <br />On January 8, 1990 the Subdivision Regulations <br />were amended to allow revisions to the phasing <br />plans of major subdivisions. The amendment <br />provides a remedy for development plans for which <br />the 12 -month time limit had expired or was about <br />to expire. <br />A letter from the applicant's agent states that <br />improvements will be completed by August 1, 1991. <br />The agent has also indicated an intent to <br />complete landscaping and road improvements by <br />December 1, 1990. <br />The Planning Staff recommends that deadline for <br />receiving approval of the Final Plat for Four <br />Birches be extended to December 1, 1990. It is <br />further recommended that if improvements are not <br />completed by that date, the letter of credit or <br />escrow agreement securing completion would be <br />written to expire on August 1, 1991. <br />Best expressed concern with the use of two dates <br />(December 1, 1990 and August 1, 1991). Kirk <br />responded that the intent of the applicant is tc <br />complete landscaping and road improvements by <br />December 1, 1990. If this cannot be <br />accomplished, the letter of credit will <br />be written to expire August 10 19916 <br />Scearbo explained that the Final Plat would be <br />submitted by December 1. Hopefully, improvements <br />would be complete by that time as that is the <br />intent of the applicant. If the improvements <br />were not complete, security would be posted. If <br />secured through a letter of credit or escrow <br />agreement, the time available to complete the <br />roads and landscaping would be extended to August <br />1, 1991. <br />
