4 <br />(3) whether factors other than market conditions and <br />beyond the control of the subdivider caused a <br />delay in meeting the phasing plan; and <br />(The developer has indicated that he had intended <br />to build the road during the dry weather of the <br />summer. Problems arose in developing a contract <br />for the grading. The developer then attempted to <br />secure a letter of credit, but was unable to <br />complete the process before the time limit <br />expired, due,in part to uncertainty about the <br />estimated grading costs.) <br />(4) whether the development project, if completed <br />consistent with the approved Preliminary Plat, will <br />tend to aid or meet an important public policy goal <br />established by the Board of County Commissioners; <br />and <br />(The subdivision is in conformance with the <br />policies and provisions of the Land Use Element of <br />the Comprehensive Plan, however, there are no <br />specific public policy goals which would be <br />particularly furthered by this subdivision.) <br />(5) whether the application for an amended phasing plan <br />was submitted before the previously approved time <br />limit(s) has lapsed; and <br />(The developer was notified in June, 1990 that the <br />Preliminary Plat would expire on August 1, 1990. <br />The application for an amended phasing plan was <br />submitted on July 25, 1990 after failure to <br />resolve grading contract issues. Extension of the <br />time limit from August 1, 1990 to December 1, 1990 <br />would allow time to install landscaping <br />improvements during the cooler weather of autumn, <br />and construct or secure construction of the <br />private roads. <br />(6) the possibility of and practicality of the <br />subdivider and developer completing the development <br />project consistent with Orange County regulations <br />applicable if the phasing plan amendment is not <br />granted. <br />(If the phasing plan amendment is not granted, the <br />developer will be required to repeat the Concept <br />Plan and Preliminary Plat approval procedures. <br />Development standards affecting the subdivision <br />have not changed since the preliminary plat was <br />approved.) <br />
