e <br />4. Time of Performance. The services of the Agency are to <br />commence no later than fifteen (15) days after the <br />execution of this Contract and shall be undertaken and <br />pursued in such sequence as to assure their expeditious <br />completion and as may he required in Scope of Services. <br />Al-' services required hereunder shall be completed on or <br />before June 30, 1991. <br />a) 0 tion to "renew Contract <br />Pend::ng the availability of federal and /or <br />state funds from the Concerned Funding Agency, <br />and the Agency's performance in complying with <br />contractual requirements set forth in this <br />Contract, the Agency will have the option to <br />renew this Agreement, for a twelve month <br />period, commencing July 1, 1991 and ending June <br />30, 1992. The option to renew is applicable <br />only to those services that generate units of <br />service. Upon receipt of Title III and state <br />appropriations from the Concerned Funding <br />Agency the COG will notify the Agency of any <br />change in the volume of units to be provided <br />during the 2nd year of the agreement. The <br />Agency shall respond to this notification via <br />certified mail within the time frame specified <br />in the notification, indicating its willingness <br />to enter into a 12 month extension. <br />b) Terms of Renewal <br />The unit cost for the extension will remain the <br />same as the initial contract with the following <br />exceptions: <br />1) Unit cost may be increased up to 10% if <br />for the period of extension, units are to <br />be reduced by no more than 10 %. If units <br />are reduced by more than 10 %, negotiations <br />may occur to increase unit cost up to 10'x. <br />The COG reserves the option to negotiate a <br />lower unit rate if units are increased or <br />other factors warrant such considerations. <br />2) The COG may negotiate a unit cost increase <br />on the basis of an increase in the <br />Consumer Price Index (CPI). If the Agency <br />proposes to increase unit costs on the <br />basis of an adjustment in the CPI, the <br />Agency must demonstrate to the <br />satisfaction of the COG that the <br />adjustment is applicable to the provision <br />of the service prior to COG approval. <br />3) Unit cost may be adjusted on the basis of <br />anticipated and justifiable increases or <br />decreases in program receipts. <br />
