NORTH CAROLINA <br />ORANGE COUNTY <br />AGREEMENT FOR THE <br />CONSTRUCTION AND <br />OPERATION OF A <br />SEWER DISCHARGE LINE <br />THIS AGREEMENT, made and entered into this the day of <br />, 1990, by and between Orange County, North Carolina, <br />P.O. Box 8181, Hillsborough, North Carolina 27278 (hereinafter <br />County or the County), and Joel L. Williams and Linda F. Williams, <br />d /b /a Cardens Mobile Home Park, 1306 Walnut Street, Cary, North <br />Carolina 27511 (hereinafter Cardens or Williams) <br />WITNESSETH: <br />WHEREAS, Williams is the owner and operator of Cardens; and <br />WHEREAS, Cardens is a mobile home park located along U.S. <br />Highway 70 east of Hillsborough in Orange County, North Carolina; <br />and <br />WHEREAS, the wastewater treatment facilities serving Cardens <br />are the subject of certain North Carolina NPDES Permit(s) and a <br />North Carolina Environmental Management Commission Special Order <br />By Consent, a copy of which is attached, labeled Exhibit A and <br />incorporated herein by reference (hereinafter Special Order), which <br />Special Order contains specific permit information and additional <br />history concerning the wastewater treatment facilities serving <br />Cardens; and <br />WHEREAS, the Special Order requires, among other things, that <br />the wastewater system outf all line be constructed and operated from <br />Cardens generally east along and with the N.C.D.O.T. right of way <br />of U.S. Highway 70 to a location on Stoney Creek; and <br />1 <br />
