NORTH CAROLINA <br />ORANGE COUNTY <br />CONTRACT AND <br />PROMISSORY <br />NOTE <br />This Contract and Promissory Note made this 6th day of <br />August, 1990 between the Animal Protection Society of Orange <br />County, Inc -, a not - for - profit, North Carolina corporation w ith <br />its principal office located in Orange County, North Carolina <br />( <br />ppS) and Orange County, a body politic and corporate under the <br />laws of North Carolina (County). <br />W I T N E S S E T H: <br />WHEREAS, County is expanding its Animal Shelter; and <br />WHEREAS, the bids received from contractors by County for <br />including desirable alternates, exceed the <br />the expansion p ro j ect, nc g <br />amount budgeted by County for the project by $61,031; and <br />,WHEREAS, on June 26, 1990, APS pledged to contribute $61,031 <br />to the Animal Shelter expansion project so that the Shelter <br />expansion, including the desirable alternates, can be <br />constructed; and <br />WHEREAS, County, in reliance on the $61,031 contribution and <br />appropriated a total of $349,4$3 ($61,031 more than <br />pledge of APS aPP ro P <br />tion contracts in the same amount <br />budgeted) and approved construc <br />for the Shelter expansion. <br />Based on the foregoing and other valuable consideration, County <br />and APS agree: <br />lete the construction of the <br />1. County agrees to comp <br />Shelter expansion project as specified in the construction <br />contracts between County and its contractors dated June 26, 1990 <br />as amended by change orders approved June 26, 1990. <br />1 <br />
