M M I � U 16 <br />(1) Windy Hill Meadow <br />(11 Lots - Little River Township) <br />b. Preliminary Plats (2 Lots) <br />(1) Property of Harold Smith <br />(2 Lots - Bingham Township) <br />Presentation by Emily Crudup. <br />The property is located in the northern part of <br />Bingham Township the east side of Buckhorn Road <br />(SR 1114) and on the south side of Simmons Lane, <br />an existing gravel road.. The tract totals 3.74 <br />acres. Two lots are proposed. Lot 1 -A contains 2 <br />acres. Lot 1 -B contains 1.74 acres. An existing <br />residence is located on Lot 1 -B. Both fats will <br />have individual wells and septic tanks. <br />The existing lot is part of the Research Support <br />Service, Inc. subdivision, recorded on March 8, <br />1989. The proposed lot is the sixth lot to be <br />created from this tract during the past two <br />years. The proposed lot could be created through <br />the minor subdivision process after March 8, <br />1991. The applicant has chosen to proceed with <br />the major subdivision. <br />In the Land Use Element of the Comprehensive <br />Plan, the property is designated as Agricultural <br />Residential and Water Supply Watershed. The 1987 <br />traffic count for Buckhorn Road was 350 trips per <br />day near the intersection with Bradshaw Quarry <br />Road. Buckhorn Road is a collector. Therefore, <br />Lot 1 -A will have access restricted to Simmons <br />Lane. <br />Simmons Lane currently provides access for nine <br />lots in addition to a 98 -acre tract. A road <br />maintenance agreement is currently on record <br />which states, "The existing sixty (60) foot road <br />right -of -way located within said property is <br />hereby dedicated to the public by this <br />declaration. That dedication was never accepted <br />by any public agency, so the road is still <br />privately maintained. The applicant has <br />submitted a justification for the road to remain <br />in private maintenance to gravel road standards. <br />Crudup gave the following summary of the staff's <br />evaluation of the applicant's private road <br />justification: <br />
