2 <br />Water Supply Watershed. The zoning is Agricultural <br />Residential and Protected Watershed II (Cane Creek). <br />The 1987 traffic count for Buckhorn Road was 350 trips <br />per day near the intersec -tion with Bradshaw Quarry <br />Road. Buckhorn Road is a collector. Lot 1 -A will have <br />access restricted to Simmons Lane, which is of a lower <br />classification. <br />Simmons Lane currently provides access for nine lots <br />in addition to a 98 -acre tract. A road maintenance <br />agreement is currently on record which states, "The <br />existing sixty (60) foot road right -of -way located <br />within said property is hereby dedicated to the public <br />by this declaration." That dedication was never <br />accepted by any public agency, so the road is still <br />privately maintained. <br />The applicant has requested that the road to remain <br />privately maintained to gravel road standards. The <br />Planning Staff's evaluation of the private road <br />justification is attached on pages 9 through 12. <br />An offer of public dedication is already on record. <br />The subdivision is located in a rural area of the Cane <br />Creek Protected Watershed. The lots are larger than <br />the minimum required. The lots cannot be further <br />subdivided due to unsuitable soils for septic tank <br />disposal. <br />The NC Department of Transportation may not accept the <br />portion of Simmons Lane adjacent.to the Smith <br />Property, even -if it were built to public road <br />standards. Some of the residences which access Simmons <br />Lane are not permanent residences, so they would <br />not count toward the minimum required density for a <br />State maintained road. Some of the residences access <br />Simmons Lane via a 10 -foot wide access easement. DOT <br />would not count those homes toward density require- <br />ments either. Based on the facts listed above, the <br />Planning Staff recommended that a road built to Class <br />A standards and privately maintained is appropriate <br />for the subdivision proposed. <br />The Resolution of Approval contains provisions <br />directing the County Manager to accept the right -of- <br />way for Simmons Lane for public use without <br />maintenance responsibility. <br />The Planning Board recommended approval of the <br />preliminary plan with a Class A private road and the <br />
