2 <br />The request was presented at the public hearing <br />on May 29. The hearing was continued to June 26 to <br />receive further information concerning the adequacy of <br />water and sewer from the Town of Hillsborough. A <br />letter from Phillip Whitaker, Town Manager, was <br />received and submitted as evidence in the June 26 <br />hearing. This letter indicates certification of <br />preliminary approval from the Town Engineer and <br />preliminary approval by the Town Board of <br />Commissioners. It also indicates that capacity is <br />available for water and wastewater treatment. The <br />Town Board granted conditional permission to tap on <br />the additional units pending the final design of the <br />addition to the system and any modifications which may <br />be necessary at the lower pump station at Woodsedge <br />Mobile Home Park. <br />In their last meeting, the Planning Board reviewed the <br />general standards, application, site plan and all <br />supporting documentation and found that the applicant <br />does comply with the standards and required <br />regulations. The Planning Board recommends approval <br />of the request with the attachment of the following <br />conditions: <br />1. The grantee of this Special Use Permit shall post with <br />Orange County, in a form acceptable to the County <br />Attorney, a bond or letter of credit in an amount <br />equal to the cost of all improvements plus 10 %. The <br />amount shall be determined on the basis of fully <br />executed construction contracts or certification by a <br />registered engineer employed by the grantee of this <br />Special Use Permit. Security for construction of the <br />improvements in this project may follow phasing in the <br />project. Specifically, as improvements are completed <br />in each phase that phase and a corresponding amount of <br />money may be released from the security instruments or <br />the security instruments may be renegotiated based on <br />the "yet to do" portion of the improvements. <br />2. Security shall be provided for the grading, paving and <br />stabilization of all cleared areas, streets and other <br />vehicular travelways; sidewalks and other pedestrian <br />walkways; erection of street signs; utility <br />installation and hookups and recreation facilities. <br />3. All necessary easements to permit utility <br />(electricity, telephone and cable television by any <br />cable television provider franchised by Orange County <br />to serve this development) installation, servicing and <br />hookups to the development and to each unit within the <br />development shall be provided at no cost to the <br />_utility provider. <br />4. Roads, parking areas, walkways, street signs, <br />utilities, recreation facilities and sites, and <br />landscaping around units shall be maintained as <br />
