The force main must be <br />constructed within the right —of —way for Hwy 70. NCDOT must <br />give its permission for this construction, and DOT will not <br />give this permission to private individuals or companies. <br />The County must be a party to the Encroachment agreement <br />and must agree to be responsible for maintenance, repair or <br />replacement of the force main and for any collateral damage <br />the line's failure may cause. In turn. the County must <br />enter into a separate agreement with the owners of Carden's <br />whereby the County can hold those owners financially <br />responsible for any costs that accrue to the County if the <br />County is forced to expend public funds for maintenance. <br />repair, etc., of the force main. <br />RECOMMENDATION: Approve and sign both agreements <br />
