PRIVATE ROAD JUSTIFICATION
for
Harmony Acres
The following justification for a private road for Harmony
Acres follows the five points on pages 30, 30a and 31 of the
April 4, 1988 revisions to the Subdivision Regulations for Orange
County, North Carolina. The five points discuss design features
to be considered in decisions to allow private roads.
General Statement
Harmony Acres is a proposed subdivision containing 7.81
acres. Access will be from Harmony Church Road, an existing
gravel state road, onto Melody Circle, a proposed Class B private
road. Melody Circle will access 6 lots in the proposed
subdivision. The lots average 1.30 acres in size. The minimum
lot is 1.30 acres. Restrictive subdivision covenants will
preclude further subdivision of Lots 1 - 6. A perpetual road
maintenance agreement will assign maintenance responsibilities
for Melody Circle to subdivision lot owners. A homeowners
association document will be drafted for the purpose of
dedicating Melody Circle to the Homeowners Association. If
Melody Circle were to be taken over by the North Carolina
Department of Transportation for maintenance, dedication by a
Homeowners Association as opposed to individual dedication by the
lot owners, allows for a more efficient transition.
1. Road Preserves Rural Character
Harmony Acres lies on 7.81 acres in a residential and
agricultural area. The property is heavily wooded with the
exception of a central area which will be used as roadway and
recreation area. This provides for maximum preservation of trees
and wildlife.
a- The average lot size is 1,30 acres. The setbacks will
be larger than the required minimum. Front 501;
Side 301; Back 301- In addition, a 60' buffer along SR
1341 (Harmony Church Road) will preserve the rural
nature of the entire subdivision. The trees in this
buffer area shall be protected by restrictive covenants.
b. The design of the subdivision utilizes natural contours
and creates a natural screening buffer along the private
road.
