4. <br />Ek I L' V „ <br />Storey Lane and Benton Drive are pre - existing <br />Public roads created during the 1950's with the <br />Acres of New Hope Subdivision. Both roads are <br />unpaved and privately maintained. Benton Drive <br />has been offered for public dedication through a <br />previously recorded right -of -way agreement. <br />A variation of the concept plan submitted was <br />approved by the Planning Board February 19, 1990, <br />with Cheng Court to be built as a Class B private <br />road and the following conditions: <br />1. With the preliminary plan, submit Road <br />Maintenance Agreements for Storey Lane, <br />Benton Drive, and Cheng Court for review and <br />approval by the County Attorney. <br />2. Submit Restrictive Covenants for review and <br />approval by the County Attorney. Covenants <br />shall include a prohibition on further <br />subdivision, larger setbacks, tree <br />protection, as well as protection of <br />significant natural features including the <br />spring(s) and rock outcroppings. <br />3. Upgrade Storey Lane from NC 86 to Cheng Court <br />to NCDOT's standards for gravel roads and <br />request that the State take over maintenance. <br />4. Maintain Benton Drive to Class B private road <br />standards. <br />On February 20, Staff met on site with the owner <br />and the surveyor to develop a preliminary plan <br />that would be desirable to the owners and address <br />Planning Staff concerns regarding site <br />sensitivity. <br />The resultant plan features: <br />1. Cheng Court shortened considerably and moved <br />up slope.from the critical area in the stream <br />buffer; <br />2. Stream crossings minimized by providing <br />access to lots 4 and 5 by Benton Drive; and <br />3. A 100 -foot stream buffer provided to protect <br />the larger spring, adjacent slopes, and rock <br />outcrops.. <br />The applicant proposes to extend Storey Lane to <br />partially connect with an existing stub -out in <br />Phase II of Stoneycreek Subdivision. The <br />stub -out is shown as a public right -of -way in <br />
