12 <br />r <br />- PRIVATE ROAD JUSTIFICATION <br />for <br />Ng Khye Weng and Ng Guat Cheng <br />The following justification for a private road for <br />Weng and Ng Guat Cheng follows the five points on pages <br />and 31 of the April 4, 1988 revisions to the Subdivision <br />Regulations for Orange County, North Carolina. The five <br />discuss design features to be considered in decisions to <br />private roads. <br />General Statement <br />Ng Khye <br />30, 30a <br />points <br />allow <br />Tanglewood Acres is a proposed subdivision containing 16.7 <br />acres. Access will be from Storey Drive, an existing Class B <br />private road, onto Cheng Court, a proposed Class B private road. <br />Cheng Court will access 6 lots in the proposed subdivision. The <br />lots average 2.78 acres in size. The minimum lot is 2.1 acres. <br />Lot A (1.41 acres) and Lot B (18.18 acres) are accessed from <br />Benton Drive (existing private road) only and are not part of <br />this subdivision In the event Lots A & B are further developed, <br />Storey Lane and Benton Drive would be upgraded to Class A <br />standards. Storey Lane Extension is addressed as a possible <br />future connector between Storey Lane (existing) and Graystone <br />Lane of the Stoneycreek Subdivision, immediately to the east of <br />this proposed subdivision. Restrictive subdivision covenants will <br />preclude further subdivision of Lots 1 - 6. A perpetual road <br />maintenance agreement will assign maintenance responsibilities <br />for Cheng Court to subdivision lot owners. A homeowners <br />association document will be drafted for the purpose of <br />dedicating Cheng Court to the Homeowners Association. If <br />Cheng Court were to be taken over by the North Carolina <br />Department of Transportation for maintenance, dedication by a <br />Homeowners Association as opposed to individual dedication by the <br />lot owners, allows for a more efficient transition. <br />1. Road Preserves Rural Character <br />The property of Ng Khye Weng and Ng Guat Cheng lies on 36.29 <br />acres in Chapel Hill Township in a residential and <br />agricultural area. <br />a. The average lot size is 2.78 acres. The setbacks will <br />be larger than the required minimum. Front 50' -601; <br />Side 30' -40'; Back 30' -40'. <br />b. The design of the subdivision utilizes natural contours <br />and creates a natural screening buffer along the private <br />road. <br />
