2 <br />new private road with NC Highway 86 and will be <br />upgraded to the State's gravel road standards. Benton <br />Drive will give lots 4 and 5 access to NC 86 and will <br />be maintained at Class B private road standards. <br />Benton Drive has been offered for public dedication <br />through a previously recorded right -of -way agreement. <br />The applicant proposes to extend Storey Lane to <br />partially connect with an existing stub -out in Phase <br />II of Stoneycreek Subdivision. The stub -out is shown <br />as a public right -of -way in Stoneycreek but was never <br />constructed. The improved roads in Stoneycreek are <br />currently State maintained. The full connection of the <br />right -of -way could be made when the adjacent property <br />to the north is subdivided. If the Preliminary Plan <br />is approved, the County will accept, on behalf of the <br />general public, the rights -of -way for Storey Lane and <br />Benton Drive for public use without maintenance <br />responsibility. <br />The concept plan for Tanglewood Acres was approved by <br />the Planning Board on February 19, 1990, with Cheng <br />Court to be built as a Class B private road and the <br />following conditions: <br />1. With the Preliminary Plan, submit Road <br />Maintenance Agreements for Storey Lane, Benton <br />Drive, and Cheng Court for review and approval <br />by the County Attorney. <br />2. Also submit Restrictive Covenants for review and <br />approval by the County Attorney. Covenants shall <br />include a prohibition on further subdivision, <br />larger setbacks, tree protection, as well as <br />protection of significant natural features <br />including the spring(s) and rock outcroppings. <br />3. Upgrade Storey Lane from NC 86 to Cheng Court to <br />NC Department of Transportation's standards for <br />gravel roads and request that the State take <br />over maintenance. <br />4. Maintain Benton Drive to Class B private road <br />standards. <br />On February 20, Staff met on site with the owner and <br />the surveyor to develop a subdivision design that <br />would be desirable to the owners while addressing <br />Planning Staff concerns regarding site sensitivity. <br />The resultant plan features: <br />I. Cheng Court shortened considerably and moved <br />up slope from the critical area in the stream <br />buffer; <br />
