Reduction of the right -of -way from the required <br />50 feet to the existing 30 feet is needed due to <br />the unwillingness of the property owners, who own <br />the road from East Lebanon to the property in <br />question, to grant additional right -of -way. <br />In an effort to rectify the insufficient right - <br />of -way width along the Riley property, the <br />Planning Department has requested that an <br />additional 10 feet of right -of -way be dedicated. <br />In the event the owner of Lot 5D wishes to <br />subdivide, he will be required to dedicate the <br />remaining 10 feet for the 50 foot right -of -way. <br />The same action would be required of the owners <br />of Lots 5, 5B, 5C and 5E as well. <br />The Planning Staff recommends approval of a <br />partial width right -of -way of 30 feet for Will <br />Riley Road. <br />Best indicated that the 30' right -of -way should <br />be 401. Garrett responded that technically, it <br />would a thirty foot right -of -way from Lebanon <br />Road to the point of the Riley property and forty <br />foot right -of -way at the Riley property. Best <br />agreed. <br />MOTION: Best moved approval of a partial width right -of- <br />way total of 40' which includes 25' of the <br />Bratcher Riley property. Z -2 -90 Elite Auto Body Shop <br />Presentation by Emily Crudup. <br />On April 2, 1990, Mr. Wayne P. Hoffman appeared <br />before the Board of County Commissioners to <br />identify a problem with the zoning on his <br />property in Bingham Township.. The Commissioners <br />scheduled a special public hearing for Tuesday, <br />May 1, 1990, to correct an error in the Zoning <br />Atlas. <br />Zoning was originally applied in Bingham <br />Township on September 2, 1981. At that time an <br />Existing Commercial (EC -5) designation was <br />approved for an existing auto paint and body shop <br />on the north side of Old Greensboro Road (SR <br />1005) approximately one half mile east of white <br />
