U1 <br />requirements of ECD, all applicable requirements of the General Statutes of <br />the State of North Carolina and any other applicable laws and Executive Orders <br />currently or hereafter in force. <br />3. Obligations of Recipient with Respect to Certain Third Party <br />Relations. ECD shall hold the recipient responsible for complying with the <br />provisions of this agreement even when the recipient designates. a third party <br />or parties to undertake all or any part of the program. The recipient shall <br />comply with all lawful requirements of ECD necessary to ensure that the <br />program is carried out in accordance with the recipient's certifications, <br />including the certification of assumption of environmental responsibilities, <br />under Rule .0601 of the North Carolina Emergency Shelter Grants Program <br />Administrative Rules, 4 NCAC 19Q. <br />4. Interest of Members, Officers, or Employees of the Recipient, Members <br />of Local Governing Body, or Otherr Public Officials. No member, officer, or <br />employee of the recipient or its agents, no member of the governing body of <br />the locality in which the program is situated, and no other public official <br />of such locality who exercises any functions or responsibilties with <br />respect to the program during his tenure or for one year thereafter, shall <br />have any financial interest, either direct or indirect, in any contract or <br />subcontract, or the proceeds thereof, for work to be performed in <br />connection with the program assisted under this agreement. Immediate <br />family members of said members, officers, employees, and officials are <br />similarly barred from having any financial interest in the program. The <br />recipient shall incorporate, or cause to be incorporated, in all such <br />contracts or subcontracts, a provision prohibiting such interest pursuant <br />to the purpose of this section. <br />The assistance provided under this agreement shall not be used in payment <br />of any bonus or commission for the purpose of obtaining ECD approval of the <br />application for such assistance, or ECD approval of applications for addi- <br />tional assistance, or any other approval or concurrence of ECD required <br />under this agreement or the North Carolina Emergency Shelter Grants Program <br />Administrative Rules, with respect thereto; provided, however, that reasonable <br />fees for bona fide technical, consultant, managerial or other such <br />services, other than actual solicitation, are not hereby prohibited if <br />otherwise eligible as program costs. <br />5. Remedies. ECD shall have grounds to carry out the actions described <br />in 4 NCAC -19Q.0604 REMEDIES when it determines that program goals and <br />objectives have not been met, that state or federal requirements have not <br />been followed, or that grant funds have been improperly expended. <br />6. Access to Records Related to ESGP Activities. The recipient will <br />give ECD, HUD and the Comptroller General, through any authorized <br />representatives, access to and the right to examine all records, books, <br />papers or documents related to the ESGP grant and will require the <br />subrecipient(s) to provide the same access to and the right to examine its <br />records, books, papers or documents related,to the ESGP grant. <br />ESGP #118 -2 (Revised 3/90) <br />
