E:? <br />Transfer of Development Rights: A system of allowing the actual <br />development rights from one tract of land to be transferred from <br />the original tract to a designated tract elsewhere for <br />development. <br />Definitions for other terms used in this document are as <br />expressed in the Land Use Element of the Comprehensive Plan <br />B. The Joint Planning Area Land Use Plan and Agreement <br />In 1987, the governing boards of Orange County, Chapel Hill and <br />Carrboro entered into an agreement to jointly establish, <br />administer and utilize a land use plan for a 45- square mile area <br />to the north and west of the Towns where a mutual interest in the <br />pattern and pace of development was held by all three parties. As <br />a part of this process, the Joint Planning Area (hereinafter <br />referred to as JPA) Land Use Plan and Map was adopted by all <br />three jurisdictions. <br />In summary, this JPA Plan created land use plan categories that <br />identified 1 Ma'or Classes of land use 2 Subclasses of land <br />use, and smaller, more specific 3 Categories of land use within <br />the Joint Planning Area, or JPA: The Mayor Classes identified and <br />adopted were Transition, Rural, and Conservation. <br />The Transition Class contains land that is located adjacent to <br />the Towns. These Transition Areas recognize the transitional <br />nature of these areas from rural uses to more urban uses. <br />The remainder of the JPA, located in the outlying areas to the <br />north and west, contains land that is more rural in nature and is <br />therefore classified as Conservation and Rural. Because these <br />categories are inter - related and inter - dependent, the JPA Plan <br />combines them into one subclass, entitled Rural Buffer. <br />It is this Rural Suffer that is the focus of the strategies <br />contained within this document. <br />I. GENERAL POLICY STATEMENTS FOR THE RURAL BUFFER <br />The charge of the 16- citizen Rural Character Study Committee has <br />been to consider the current land use conditions, development <br />standards, and resource protection methods for the Rural Buffer. <br />In so doing, the objectives of the Study have been defined as <br />follows: <br />To guide and direct the development of a comprehensive Rural <br />Character Study /Open Space Plan for the County, with an objective <br />of coordinating the issues of: <br />- Agricultural Preservation <br />- Natural Resource Protection <br />- Visual Resource Protection <br />Growth Management <br />
