Zoning Atlas Amendments <br />Jacobs suggested that rather than having staff <br />make presentations on these items, Board members <br />ask specific questions. <br />(1) Z -8 -89 Envirotek, Inc. <br />Yuhasz asked how a request could be made for a <br />zoning designation that is not allowed in the <br />Rural Buffer. Scearbo responded that when the <br />original request was made, the zoning matrix <br />did not include the Rural Buffer. The Board <br />determined that the text of the Land Use Plan <br />was the control and the request was reviewed <br />in the context of the text. The proposal was <br />evaluated and found to be inconsistent with the <br />Rural Buffer. The matrix has been corrected and <br />does include the Rural Buffer district. <br />Lewis indicated he was appointed to the <br />Planning Board during the time of the <br />establishment of the Rural Buffer district so <br />he was not aware of everything that had <br />happened with this issue from the beginning. <br />He expressed concern that the statements made <br />by Mr. Phears at the public hearing did indicate <br />the applicant had been misled. <br />Jacobs noted that he was not on the Board when <br />this issue first arose but that he felt the real <br />impetus was the public opposition to commercial <br />activity in that particular community. <br />Lewis again expressed concern that if the <br />applicant was indeed misled at the time the Rural <br />Buffer was established, the request should not be <br />denied. <br />MOTION: Best moved approval of the Planning Staff <br />
