NLTNHQ 17 APRIL 1989 <br />3. This proposed zoning change would carry out the intent <br />and purpose of the adopted land use in that it would <br />enhance the adopted plan. This change would address the <br />need for different activities other than residential <br />bordering I -40 which could not only act as additional <br />buffer between I -40 and the surrounding community but <br />also address the lack of consideration given to the <br />property impacted directly by I -40. <br />4. We offer the following in support of this rezoning <br />a. This site is located in an area which is not to be <br />served with public utilities (sewer and water) for <br />at least 20 years. Restrictions,, therefore, would <br />be self imposing upon any development. Density and <br />intensity of development would be limited as a <br />result. <br />b. The proposed zoning change would correct the fact <br />that the existing zoning ordinance fails to <br />recognize negative impacts of an interstate highway <br />.on adjacent properties. This would be done by <br />giving the opportunity to allow for a reasonable, <br />acceptable usage of these negatively impacted <br />properties. <br />C. The proposed zoning parallels the existing zoning in <br />terms of uses. The only differences being that those <br />uses permitted in 'AR' district which are not <br />permitted in 'RBI district are further regulated by <br />requiring a special use permit. <br />d. The initial impacts of noise that. the county <br />considered prior to the completion of I -40 were in <br />error.. The actual size of the impacted area, and db <br />level, is greater then was anticipated. <br />
