NLTNH4 17 APRIL 1989
5
The following are statements of justification addressing
issues I through 4 as outlined on the attached Application for
Change of Zoning District.
1. The Zoning ordinance as it exists and the policies which
generated and administer this ordinance as they exist are
in error for the following reasons :
a. The present zoning fails to recognize negative
impacts of an interstate highway on adjacent
properties and allow for a reasonable, acceptable
usage of these negatively impacted properties.
b. The present zoning violates fundamental principles
of planning by not providing for a variety of
residential services available to the residential
areas. The present zoning does not allow for the
orderly provision o:' services to support desired
residential usage of the area.
C. The proposed amendment will correct the error of the
existing zoning by allowing functions other than
residential use at a 1 per 2 acre density at this
location. Residential use at this proximity to I -40
is not practical and not desirable due mainly to the
impact of sound fror. I -40. Changing the zoning at
this area would allow more flexibility in the use of
this property. Also, the requested change would
establish a descending hierarchy of uses from I -40
to the lower residential densities. This hierarchy
will provide an excellent transition from the
intensity of I -40.
2. The completion of the I -40 corridor is the major change
in the county that necessitates the rezoning. The
present zoning fails to recognize the negative impacts of
the interstate highway on the adjacent properties. The
zoning as it exists doer not allow for a reasonable,
acceptable usage of these negatively impacted properties.
This proposed change in zoning would not only give more
reasonable alternatives to the impacted properties but
also would establish a de ;irable transition between I -40
and the surrounding comminity. This change would not
result in additional negative impacts on public health,
safety and general welfare and would result in an
improvement on the present conditions.
