G23 <br />an undeveloped part of lot 30. The proposed <br />• rezoning is to: 1) correct an error in the Zoning <br />Atlas by shifting the EC -5 district west to its <br />proper location and out of the right -of -way; and <br />2) extend the district three (3) feet to the <br />north so that the structure and a proposed <br />addition will meet required setbacks. <br />The Planning Staff's recommended location of the <br />EC -5 district boundaries is consistent with the <br />intent of the Zoning Ordinance in that: <br />1) The auto body shop originally should have <br />been zoned Existing Commercial and additions <br />to existing structures are permitted under <br />EC -5; and <br />2) If the 1981 EC -5 lot were simply shifted to <br />the western boundary, the existing structure <br />would not meet setbacks required by Article <br />6.5 . 1 (20). <br />At the public hearing on May 1, the applicant <br />requested that the proposed EC -5 district <br />boundary be re- aligned to include the existing <br />sign which identifies his business. In response <br />to his request, the Planning Staff has revised <br />the proposed district boundary as shown on the <br />site plan included in the agenda packet. <br />One citizen spoke in favor of the proposed <br />rezoning; no one spoke in opposition. The <br />Commissioners referred the -item to the Planning <br />Board for a recommendation to be presented at <br />their meeting on May 29, 1990. <br />The Planning Staff recommends approval of the <br />proposed rezoning from AR to EC -5. <br />MOTION: Best moved approval of the Planning Staff's <br />findings on Article 20.3.2 a, 20.3.2 b, <br />20.3.2 c, 20.3.2 d, 20.3.2 e, and Article <br />4.2.12 a and 4.2.12 b. Seconded by Cantrell. <br />VOTE: Unanimous. <br />MOTION: Best moved approval as recommended by the <br />Planning Staff. Seconded by Reid. <br />VOTE: Unanimous. <br />40 <br />
