Sections IV- B -3 -d -2 and V- D- 6 -b -2,. and to add Section <br />V- D -6 -b -3 to the Subdivision Regulations. The <br />amendments would clarify access requirements for each <br />lot and provide for a Certificate of Dedication when <br />land is publicly dedicated. <br />BACKGROUND: When a private road is proposed within a subdivision, <br />the ordinance guarantees right of access by all lots <br />served by the road. The proposed amendment would <br />clarify that each lot would have access from a State, <br />municipal or private road. <br />When land in a subdivision is currently proposed for <br />public dedication, the County Commissioners accept <br />that dedication during approval of the Preliminary <br />Plan. The Resolution of Approval of the Preliminary <br />Plan states that the "County Commissioners accept the <br />irrevocable offer of dedication upon recordation <br />without maintenance responsibility ". The proposed <br />amendment would provide for a Certificate of <br />Acceptance of Dedication that would be placed on the <br />Final Plat. By acceptance of the Preliminary Plan <br />Resolution of Approval, the County Commissioners would <br />authorize the County Manager to sign the certificate <br />on the Final Plat. The certificate would be signed <br />prior to recordation of the plat. <br />RECOMMENDATION: The Administration recommends that the proposed <br />amendment be referred to the Planning Board for <br />recommendation. <br />
