Sections IV- B -3 -d -2 and V- D- 6 -b -2,. and to add Section V- D -6 -b -3 to the Subdivision Regulations. The amendments would clarify access requirements for each lot and provide for a Certificate of Dedication when land is publicly dedicated. BACKGROUND: When a private road is proposed within a subdivision, the ordinance guarantees right of access by all lots served by the road. The proposed amendment would clarify that each lot would have access from a State, municipal or private road. When land in a subdivision is currently proposed for public dedication, the County Commissioners accept that dedication during approval of the Preliminary Plan. The Resolution of Approval of the Preliminary Plan states that the "County Commissioners accept the irrevocable offer of dedication upon recordation without maintenance responsibility ". The proposed amendment would provide for a Certificate of Acceptance of Dedication that would be placed on the Final Plat. By acceptance of the Preliminary Plan Resolution of Approval, the County Commissioners would authorize the County Manager to sign the certificate on the Final Plat. The certificate would be signed prior to recordation of the plat. RECOMMENDATION: The Administration recommends that the proposed amendment be referred to the Planning Board for recommendation.
