olo <br />portion of the property. The zoning lot was shown 243 <br />feet east of the body shop on an undeveloped part of <br />lot 30. The proposed rezoning is to: 1) correct an <br />error in the Zoning Atlas by shifting the EC -5 <br />district west to its proper location and out of the <br />right -of -way; and 2) extend the district three (3) <br />feet to the north so that the structure and a proposed <br />addition will meet required setbacks (refer to <br />attached site plan). <br />The Planning Staff's recommended location of the EC -5 <br />district boundaries is consistent with the intent of <br />the Zoning Ordinance in that: <br />1) The auto body shop originally should have been <br />zoned Existing Commercial and additions to <br />existing structures are permitted under EC -5; <br />and <br />2) If the 1981 EC -5 lot were simply shifted to the <br />western boundary, the existing structure would <br />not meet setbacks required by Article 6.5.1 <br />(20). <br />At the public hearing on May 1, the applicant <br />requested that the proposed EC -5 district boundary be <br />re- aligned to include the existing sign which <br />-identifies his business. In response to his request, <br />the Planning Staff has revised the proposed district <br />boundary as shown on the attached site plan. <br />One citizen spoke in favor of the proposed rezoning; <br />no one spoke in opposition. The Commissioners <br />referred this item to the Planning Board for a <br />recommendation to be presented at their meeting on May <br />29, 1990. <br />On May 21, the Planning Board recommended approval of <br />the proposed rezoning with the EC -5 district boundary <br />revised to include the existing sign as requested by <br />the applicant and recommended by Staff. <br />RECOMMENDATION: The Administration recommends approval of the proposed <br />rezoning from AR to EC -5 as per the Planning Board's <br />recommendation. <br />• <br />11 <br />10 <br />
