The reference is corrected to the <br />proper section of the ordinance. <br />IV- B -2 -d -3 <br />This new section describes the requirement for a property owners' association. This <br />requirement is strongly recommended in order to have an entity which is clearly <br />responsible for road maintenance. The use of property liens is necessary to enforce <br />payment for road maintenance without direct County involvement. <br />V- D- 6 -b(2) <br />Recommended revisions to this section broaden the right of access, and refer to <br />property owners' associations. Also, statements limiting public liability and requiring <br />notification of purchasers should be added. <br />The purpose of these changes is to ensure that purchasers of lots served by private <br />roads are aware of the liabilities and limitations of such roads. <br />The declaration of restrictions and maintenance of private roads, attached as Appendix <br />C of this report, has been used and may address some of the concerns regarding <br />maintenance. The County Attorney should weigh the benefits of this agreement versus <br />the use of property owners' associations. <br />APPENDIX A: QRANGE COUNTY PRIVATE ROAD STAND DS <br />This Appendix consists primarily of design and construction standards for private <br />roads. The introductory section discusses nolicv and nmeodurai ;ee,.ee •rti.e <br />recommended changes here include limiting the number of dwelling units as well as lots <br />to be served by various classes of private roads, and limiting the number of lots served <br />by .any road not constructed to NCDOT standards to 25. <br />Private maintenance signs should be installed on all private roads; reference to such a <br />sign is added to the construction sequence. <br />35 <br />
