M <br />Private roads, when properly constructed and maintained, can function well to carry <br />low volumes of traffic in limited areas. However, a number of problems have arisen <br />with private roads, including: <br />- desire to have a public body assume maintenance responsibility <br />- poor maintenance due to lack of cooperation or funding by private owners <br />- traffic increase that exceeds roadway capacity due to additional <br />development <br />- liability for traffic accidents <br />- difficulty of access for school buses, trash pick -up, or emergency services <br />due to substandard design or maintenance <br />desire to extend or widen a private street <br />- street names <br />- uniform signing <br />Due to the above potential problems, any proposed private road should be thoroughly <br />evaluated to assure that it is both necessary and desirable. We agree with present <br />county policy that the applicant should bear the burden of proof for justifying private <br />roads and providing for their continued maintenance. <br />21 <br />
