Amend Section IV- B -3 -d -2 to require a subdivider <br />to insure right of access for a proposed private <br />road to a public street by way of direct access or <br />other private roads, record an instrument with the <br />final plat guaranteeing access to law enforcement <br />and emergency vehicles, and provide notice that <br />future development dependent on the road for access <br />will require upgrading to a higher private road <br />standard or public dedication and upgrading to state <br />standards. <br />5. Amend SECTION V- D-- 6 -b(2) OF THE SUBDIVISION REGULATIONS <br />ENTITLED CERTIFICATES OF DEDICATION AND MAINTENANCE to <br />require the recording of a document which guarantees <br />right of access for proposed private road to a public <br />street by way of direct access or other private roads, <br />access to law enforcement and emergency vehicles, and <br />notice that future development dependent on the road for <br />access will require upgrading to a higher private road <br />standard or public dedication and upgrading to state <br />standards. The amendment would also add a new <br />subsection (3) which requires that a certificate be <br />placed on the final plat, for signature by the County <br />Manager, acknowledging acceptance of dedication, without <br />maintenance responsibility, of offers of public <br />dedication of rights -of -way, easements, streets, <br />recreation areas, and other improvements. <br />ORANGE COUNTY PRIVATE ROAD STANDARDS <br />The proposed amendments to the Orange County Private <br />Road Standards are as follows: <br />I. Specifying 25 lots or dwelling units as the maximum that <br />can be served by a Class A private road and requiring a <br />road serving a greater number of lots or dwellings to be <br />constructed to State standards. <br />2. Requiring that private road construction must be <br />inspected and construction certified by a professional <br />engineer or registered surveyor. <br />3. Adding under STANDARDS FOR PRIZE ROADS, that a <br />professional engineer or registered surveyor certifies <br />that the road has the proper dimensional requirements, <br />is located properly within the right -of -way, is <br />constructed of approved materials, and provides all <br />other required improvements. <br />
