n <br />E <br />Society before presentation to the Board of <br />Commissioners. <br />MOTION: The suggestion by Collins was accepted as a <br />motion by Best and seconded by Burklin. <br />VOTE: Unanimous. <br />AGENDA ITEM #8: SUBDIVISION APPLICATIONS <br />a. Preliminary Plats (1 Lot) <br />(1) Durham Estates - Plan Amendment <br />(10 Lots Chapel Hill Township) <br />Presentation by Eddie Kirk. <br />The Preliminary Plan for the Durham Estates was <br />approved by the County Commissioners on February <br />5, 1990. The approval provided for lots 7, 8 and <br />9 to receive access from Lumley Drive in Laurel <br />Springs Subdivision. Lot 6 was to receive access <br />from Dairyland Road, since it did not have <br />frontage on Lumley Drive. <br />The applicant has requested that the Preliminary <br />Plat be revised to provide a 30 foot access <br />easement between lots 7 and 8 for access to lot <br />6. Several environmental advantages of access <br />via the easement are indicated in a letter from <br />Mark O'Neal, agent for Mr. W. T. Durham. First, <br />it shortens the driveway through lot 6. Second, <br />it keeps the driveway away from a drainage area <br />leading to Morgan Creek. Finally, it allows the <br />lot to access onto a road of lower <br />classification. Lumley Drive is considered a <br />Minor Street, whereas, Dairyland Road is a <br />Collector Street. <br />The Planning Staff recommends that item E3 of the <br />Resolution of Approval be amended to include a <br />30 -foot access easement between Lots 7 and 8 for <br />access to Lot 6, and that item C2 be amended <br />reference the watershed protection standards for <br />University lake Watershed. (A copy of the <br />revised Resolution of Approval is attached to <br />these minutes on pages .) <br />Discussion followed regarding the applicant's <br />proposed easement rather than access onto <br />Dairyland Road. Concern was noted that lots 7 <br />and 8 would also use the easement as access <br />rather than driveways on each of those lots. <br />
