A <br />70 <br />(c) Section III -D -4 Final Plat /Major <br />Subdivision <br />Presentation by Mary Scearbo. <br />The proposed amendments include a time limit <br />on appeals of minor subdivisions, and major <br />subdivision concept plans and final plats. <br />Section III of the Subdivision Regulations <br />contains the application and approval <br />procedures for major and minor subdivisions. <br />Currently, the provisions for subdivision <br />appeals do not include a time limit between <br />the Planning Board or Planning Department <br />decision on an application and when the <br />appeal of that decision may be requested. <br />A time limit on appeals is necessary since. <br />since regulations and policies affecting an <br />application as well as subdivision site <br />conditions may change an application as well <br />as subdivision site conditions may change <br />considerably before the applicant's <br />contention for an appeal may be resolved. <br />The Planning Staff recommends a time limit of <br />thirty (30) days to be consistent with the <br />time limit for appeals set forth in the <br />Zoning Ordinance. <br />Burklin asked if the thirty days was for the <br />preparation of the appeal or notification of <br />intent to appeal. Scearbo responded that it <br />was for notification of intent to appeal. <br />(4) Flag Lots <br />(a) Section IV -B -5 -d Road Access /Extension <br />Presentation by Mary Scearbo. <br />This proposed amendment is to expand the <br />criteria used in permitting the creation of <br />flag lots. <br />Flag lots may be created only to eliminate <br />access onto an arterial or to use land which <br />is irregularly shaped, contains slopes, or <br />has limited area available for septic <br />disposal. <br />An easement or road must be created for <br />access if the above criteria do not apply. <br />The total time and costs involved in the <br />
