PROPOSED ORDINANCE AMENDMENT <br />ORDINANCE: SUBDIVISION REGULATIONS <br />REFERENCE: SECTION IV- B -3 -d -2 STREETS <br />SECTION V -D -6 -b CERTIFICATES OF DEDICATION AND <br />MAINTENANCE <br />ORIGIN OF AMENDMENT: _x_ Staff Planning Board <br />BOCC Public <br />Other: <br />STAFF PRIORITY RECOMMENDATION: High —x—middle Low <br />Comment: <br />EXPECTED PUBLIC HEARING DATE: May 29, 1990 <br />PURPOSE OF AMENDMENT: <br />To amend Section IV- B -3 -d -2 and Section V- D- 6 -b(2) and to add <br />Section V- D- 6 -b(3) to the Subdivision Regulations. These <br />sections would clarify access requirements for each lot and <br />provide for a Certificate of Dedication when land is publicly <br />dedicated. The Certificate would be affixed to the final <br />plat and signed by the County Manager. <br />IMPACTS /ISSUES: <br />When a private road is proposed within a subdivision, the <br />ordinance guarantees right of access by all lots served <br />by the road. The proposed amendment would clarify that <br />each lot would have access from a State, municipal or private <br />road. <br />When land in a subdivision is currently proposed for public <br />dedication, the County Commissioners accept that dedication <br />during approval of the Preliminary Plan. The Resolution of <br />Approval of the Preliminary Plan states that the "County <br />Commissioners accept the irrevocable offer of dedication upon <br />recordation without maintenance responsibility ". The <br />proposed amendment would provide for a Certificate of <br />Acceptance of Dedication that would be placed on the Final <br />Plata By acceptance of the Preliminary Plan Resolution of <br />Approval, the County Commissioners would authorize the County <br />Manager to sign the certificate on the Final Plat. The <br />certificate would be signed prior to recordation of the plat. <br />60 <br />
