5 8 <br />Any such terms and conditions may be negotiated between the <br />subdivider /landowner and the utility company. Provided, <br />however, that where utilities are required for subdivision <br />approval, the Planning Board shall require an instrument <br />executed by the subdivider /landowner and the utility company <br />setting forth the said terms and conditions at the time the <br />preliminary plan is reviewed by the Planning Board. <br />IV -S -6 -c The followin provisions shall apply to the location of <br />utility easements Lexcluding "blanket easements") serving <br />the subdivision or lots outside of the subdivision: <br />(.,) The easement shall not cross a septic field, its repair <br />area, or any part of a sic easement. <br />(2) Utilities locatad in setbacks, designated open s an ce" <br />land use buffed or tree Rrotection areas shall be <br />placed underground. <br />(3) Utilities shall not be located in a stream buffer <br />exceRt as necessary to cross a stream. My such <br />crossing shall be perpendicular to the stream. <br />(4) A minimum of ten 1101 feet shall be maintained between <br />the easement and Any property boundary, unless <br />suf_f -cient evidence is presented by the utility <br />provider indicating that there is no feasible <br />alternative location for the easement. <br />SECTION V SPECIFICATIONS FOR PLAT DRAWINGS <br />V -D FINAL PLAT <br />V -D -S Subdivision Layout Design <br />V- D -S -c. utility and Drainage Data <br />The location and purpose of all new easements for utility <br />systems shall be shown on the Final Plat, including, but not <br />-limited to, sanitary sewers, septic tanks and nitrification <br />fields, storm sewer lines, water mains, gas, transmission <br />mains and overhead electric, telephone and CATV transmission <br />mains, and any other above or below ground utility systems <br />which are contained within a designated easement. <br />It is understood that utility distribution systems to <br />individual lots for gas, electric, telephone, and TV cable <br />service are customarily covered by "blanket easements" or <br />"general easements". If these easements have been recorded, <br />the recording data shall be shown on the plat. ^theL=i•ss, <br />
