56 <br />The proposed amendment would create standards to apply <br />of easements, require the designation of all easements <br />and allow for relocation of easements to be approved by <br />Department. <br />The proposed amendment is summarized as follows: <br />to the location <br />on Final Plats, <br />the Planning <br />1) Utilities within specific easements may not cross septic <br />disposal areas; must be located underground if within setback, <br />open space, or buffer areas; must cross streams at right angles; <br />and must be 10 feet away from property lines unless no other <br />location is feasible. <br />2) All existing or proposed easements, including those for <br />distribution lines, are to be shown on the Final Plat. <br />3) The Final Plat must be consistent with the Preliminary Plat <br />(currently required) <br />4) If the location of an easement on a Final Plat is significantly <br />different from that approved on the Preliminary Plan, then the <br />Preliminary Plat must be revised. The revision can be approved <br />by the Planning Director if standards are met. The decision of <br />the Planning Director can be appealed to the Board of County <br />Commissioners. <br />5) The Board of Commissioners must approve a revision to the <br />Preliminary Plan if utilities are to be installed within an <br />easement which was not shown on the Preliminary Plan. <br />The amendment also establishes a procedure by which a Preliminary Plat <br />can be revised. The standards would apply to all subdivisions, whether <br />major or minor. Revision procedures, however, are not proposed for <br />minor subdivisions, because all action is by the Planning Department. <br />Any differences between the Concept Plan and Final Plat can be <br />immediately reviewed for compliance with the Subdivision Regulations, <br />and a decision can be made to approve or deny the change. As with all <br />decisions of the Planning Department, the applicant may appeal to the <br />Planning Board and Board of County Commssioners. <br />EXISTING AND PROPOSED ORDINANCE PROVISIONS: <br />SECTION III APPLICATION AND APPROVAL PROCEDURES <br />III -D APPROVAL PROCEDURES FOR MAJOR SUBDIVISIONS <br />III -D -5 REVISIONS TO PRELIMINARY PLAT <br />Revision to the_Preliminar Plat is required if any asa2ect <br />of the Final Plat is not in substantial _compliance with the <br />Preliminary Plat and/or Resolution of ApRKoval of the Board <br />
