e <br />52 <br />PROPOSED ORDINANCE AMENDMENT <br />ORDINANCE: SUBDIVISION REGULATIONS <br />REFERENCE: SECTION IV -B -5 -d - FLAG LOTS <br />ORIGIN OF AMENDMENT: X Staff Planning Board <br />BOCC Public Other: <br />STAFF PRIORITY RECOMMENDATION: High _X Middle Low <br />Comment: <br />EXPECTED PUBLIC BEARING DATE: May 29, 1990 <br />PURPOSE OF AMENDMENT: <br />To expand the criteria used in permitting the creation of flag lots. <br />IMPACTS /ISSUES: <br />Flag lots (see attached diagram) may be created only to eliminate <br />access onto an arterial or to use land which is irregularly shaped, <br />contains steep slopes which limit building area, or has limited area <br />available for septic disposal. <br />Many subdivisions submitted to the Planning Department involve the <br />creation of a private road easement to provide access to a single lot. <br />A road maintenance agreement must be prepared, and if the road is <br />more than 500 feet in length, it must be constructed to Orange County <br />private road standards. In some cases, the function of the "road" will <br />be only to serve as a driveway for a single residence. <br />The total time and costs involved in the subdivision approval process <br />significantly increases when new roads are required. Providing <br />assurance of legal access rights and proper road construction and <br />maintenance involves research and review by the applicant or his /her <br />attorney, as well County staff. . <br />The proposed amendment would allow a flag lot to be created if a road <br />would not be needed for access to another lot, and future extension of <br />the road would be unlikely. <br />
