DUTTON <br />Of Counsel <br />Enclosed you will find a draft Temporary Electric <br />Power Ordinance, redrafted <br />BONNER D. SAWYER <br />(1902 -1972, <br />from the version drafted by <br />Planning <br />g Staff and you and delivered to us b <br />y you on <br />January 30, 1990. We have incorporated some of the <br />provisions of the proposed changes to the North <br />Carolina Building Code, as outlined in the letter to <br />Mr. <br />Sam T. Snowdon from Mr. Lee-Hauser, P.E. dated <br />February 8, 1990. <br />In general, however, the proposed <br />changes to the Code relating to temporary power do <br />not <br />Provide sufficient standards for determining when <br />temporary power is appropriate. Therefore, we <br />recommend that, even if the Code is amended to include <br />Provisions for temporary <br />power, the County.still <br />regulate temporary power by ordinance. If the Code is <br />so amended, please send us a copy of the adopted <br />amendments. <br />We have changed a few provisions in the Staff's <br />draft and wish to call these changes to your attention. <br />We have made the maximum life of a temporary power <br />Permit 15 days because we can think of no reason why an <br />applicant.would need temporary power for any longer <br />period. Temporary power for a longer period would not <br />be truly "temporary" within the meaning of the <br />Ordinance. Also, we'have deleted the appeal provision <br />in the Staff's draft and made an Inspector's or the <br />Director's decision on an application final. <br />We have crafted the Ordinance to provide for <br />temporary electric power only in specified <br />circumstances. Basically, temporary power will be <br />appropriate only where the circumstances present in <br />Section 5(a) of the Ordinance are present and only then <br />if saw service is unavailable.
