If the Department or the State should be determined out of am pliance <br />with the provisions of the contract, either party may file a formal <br />appeal with the Department of Environment, Health, and Natural <br />Resources. The appeal shall be heard by the Department of Environment, <br />Health, and Natural Resources within twenty (20) days of the written <br />request.
