Interlocal Agreement Between Orange County and the Town of Hillsborough for <br /> 23 Construction and Operation of Water and Sewer Facilities in the Hillsborough <br /> 24 Area Economic Development District of Orange County <br /> 25 The Board reviewed and considered approving the interlocal agreement with the Town <br /> 26 of Hillsborough that sets forth conditions of utility installation and operation with associated land <br /> 27 use consistency with prior cooperative planning efforts and authorized the Chair to sign. <br /> 28 <br /> 29 BACKGROUND: <br /> 30 Orange County and the Town of Hillsborough have been coordinating planning efforts around <br /> 31 the common interest land fringes of the Town of Hillsborough since 2002. These efforts led to <br /> 32 more a formalized 2007 acceptance of an area `Strategic Growth Plan' and the pursuit of an <br /> 33 interlocal agreement that proposed additional implementation steps by both local governments. <br /> 34 The Interlocal Agreement between Orange County and the Town of Hillsborough for <br /> 35 construction and operation of water and sewer facilities in the Hillsborough Area Economic <br /> 36 Development District of Orange County was presented at the May 2, 2017 Board of County <br /> 37 Commissioners meeting. <br /> 38 <br /> 39 Following this meeting, the attorney for the Town of Hillsborough suggested modifications to the <br /> 40 agreement to further define how the determination of capacity is made by the Town. This <br /> 41 includes consistency with Hillsborough's adopted Future Land Use Plan for the specific area in <br /> 42 the southwest quadrant and further limits connections to "industrial and commercial". In <br /> 43 addition, the word "only" was deleted from Section 4 which allows the consideration of"other <br /> 44 aspects outlined herein" (such as land use, reservation period, etc.) to be operative instead of <br /> 45 "only" a capacity determination. This agreement does not include proposed expansions to the <br /> 46 WASMPBA primary area, if approved, which were primarily (over 80%) in the southeast <br /> 47 quadrant. The proposed agreement is included in Attachment 1. The agreement was presented <br /> 48 and approved at the Hillsborough Board of Commissioners meeting on September 25, 2017. <br /> 49 <br />
