7 <br /> FTA FISCAL YEAR 2017 CERTIFICATIONS AND ASSURANCES <br /> PREFACE <br /> Before the Federal Transit Administration (FTA or We) may award federal assistance for <br /> public transportation in the form of a federal grant, cooperative agreement, loan, line of <br /> credit, loan guarantee, master credit agreement, or State Infrastructure Bank(SIB) <br /> cooperative agreement certain pre-award Certifications and Assurances are required, <br /> except as FTA determines otherwise in writing. The Applicant must authorize a <br /> representative (Authorized Representative) to select and sign its Certifications and <br /> Assurances and bind the Applicant's compliance. You, as your Applicant's Authorized <br /> Representative, must select and sign all Certifications and Assurances that your <br /> Applicant must provide to support each application it submits to FTA for federal <br /> assistance during federal fiscal year (FY) 2017. <br /> We request that you read each Certification and Assurance and select those that will <br /> apply to any application for which your Applicant might seek FTA assistance during <br /> FY 2017. As provided by federal laws, regulations, and requirements, FTA may award <br /> federal assistance only if the Applicant's Authorized Representative selects adequate <br /> Certifications and Assurances. <br /> We have consolidated our Certifications and Assurances into twenty-three (23) <br /> Categories. At a minimum,you must select the Assurances in Category 01. If your <br /> Applicant requests more than $100,000 in federal assistance,you must select the <br /> "Lobbying" Certification in Category 02, except if your Applicant is an Indian tribe, <br /> Indian organization, or an Indian tribal organization. Depending on the nature of your <br /> Applicant and the Award it seeks,you may also need to select one or more Certifications <br /> and Assurances in Categories 03 through 23. Instead of selecting individual Categories <br /> of Certifications and Assurances, however,you may make a single selection that will <br /> encompass all twenty-three (23) Categories of Certifications and Assurances that apply <br /> to our various programs. <br /> FTA, the Applicant, and the Applicant's Authorized Representative, understand and <br /> agree that not every provision of these twenty-three (23) Categories of Certifications and <br /> Assurances will apply to every Applicant or every Award or Project included in an <br /> Award, even if you make a single selection encompassing all twenty-three (23) <br /> Categories. Nor will every provision of each Certification or Assurance within a single <br /> Category apply if that provision does not apply to your Applicant or the Award it seeks. <br /> The type of Applicant and its application will determine which Certifications and <br /> Assurances apply. <br /> Your Applicant is ultimately responsible for compliance with the Certifications and <br /> Assurances selected that apply to its Award, itself any Subrecipient, or any other Third <br /> Party Participant in its Award, except as FTA determines otherwise in writing.
