44 <br /> FTA FISCAL YEAR 2017 CERTIFICATIONS AND ASSURANCES <br /> As required by 49 U.S.C. § 5324(d), on behalf of your Applicant, you assure that it will: <br /> 1. Comply with the requirements of the Certifications and Assurances as FTA determines will <br /> apply to an Applicant for federal assistance appropriated or made available for the Public <br /> Transportation Emergency Relief Program, and <br /> 2. Comply with FTA regulations, "Emergency Relief," 49 C.F.R. part 602. <br /> CATEGORY 20. EXPEDITED PROJECT DELIVERY PILOT PROGRAM. <br /> Before FTA may provide federal assistance for an Award financed under the Expedited Project <br /> Delivery Pilot Program authorized under section 3005(b) of the FAST Act,you must select the <br /> Certifications in Category 20, except as FTA determines otherwise in writing. <br /> To the extent that any Certification in Category 20 does not apply, it will not be enforced. <br /> As required by section 3005(b)(3)(B) of the FAST Act, except as FTA determines otherwise in <br /> writing, on behalf of your Applicant, you certify that: <br /> 1. It has or will have the legal, financial, and technical capacity to carry out its Award, <br /> including the safety and security aspects of that Award. <br /> 2. It has or will have satisfactory continuing control over the use of its equipment and facilities <br /> acquired or improved under its Award. <br /> 3. It will maintain its equipment and facilities acquired or improved under its Award in <br /> accordance with the recipient's transit asset management plan and consistent with FTA <br /> regulations, "Transit Asset Management," 49 CFR part 625. <br /> 4. It will comply with: <br /> a. The metropolitan transportation planning requirements of 49 U.S.C. § 5303, and <br /> b. The statewide and nonmetropolitan transportation planning requirements of 49 U.S.C. <br /> § 5304. <br /> CATEGORY 21. INFRASTRUCTURE FINANCE PROGRAMS. <br /> Before FTA may provide credit assistance for an Award that also is or will be financed under the <br /> Transportation Infrastructure Finance and Innovation Act(TIFIA)Program authorized under <br /> 23 U.S.C. 0 601— 609, or the State Infrastructure Banks (SIB)Program authorized under <br /> 23 U.S.C. § 610,you must select the Certifications in Category 21. <br /> If the Applicant does not receive credit assistance under the TIFIA or SIB programs, the <br /> Certifications and Assurances in Category 21 will not be enforced. <br /> 21.A. Transportation Infrastructure Finance and Innovation Act(TIFIA) Program. <br /> If your Applicant seeks federal assistance from FTA for an Award that also is or will be financed <br /> under the TIFIA Program authorized under 23 U.S.C. 0 601 —609 the Certifications and <br /> Assurances in Category 21.A apply to your Applicant. In administering this Program, the FAST <br /> Act cross-cutting requirements supersede inconsistent former requirements. <br /> 38 <br />
